Pelosi says impeachment and 25th Amendment resolutions will be presented to the House starting Monday

House Speaker Nancy Pelosi (D-CA) issued a letter to her dear colleague outlining her plan to initiate President Trump’s impeachment process and to call on Vice President Pence to invoke the 25th Amendment. Both initiatives are unlikely to succeed beyond votes in the House. However, Pelosi plans to make Trump the only president to be impeached twice even if no Senate trial takes place.

Senator Roy Blunt (R-MO) told KSHB-TV on Friday that impeachment will not happen in the Senate:

Pelosi said a motion for unanimous consent will be presented on Monday on the 25th Amendment. If that fails, which is likely, a vote will take place on Tuesday. Impeachment legislation will follow, Pelosi said.

Dear colleague, on the next steps in protecting our democracy

Dear Democratic colleague,

On this Sunday, as we pray that God will continue to bless America, I am writing to inform you of our next actions, which will be done with the great solemnity that this time requires.

I want to draw your immediate attention to the action to be taken tomorrow morning when Majority Leader Hoyer seeks unanimous consent to move the Raskin resolution. This resolution calls on the Vice President to summon and mobilize the Cabinet to activate the 25th Amendment to declare the President unable to perform the duties of his office, after which the Vice President would immediately exercise the powers of Acting President. The text of the resolution is available here.

If we do not receive unanimous consent, this bill is scheduled to be introduced the next day. We call the vice president to respond within 24 hours.

Then we will proceed to the presentation of the impeachment legislation.

In protecting our Constitution and our democracy, we will act urgently, because this president poses an imminent threat to both. As the days go by, the horror of this President’s continued assault on our democracy intensifies, as does the need for immediate action.

I look forward to our call for caucus tomorrow. I thank all members for the suggestions, observations and contributions you have sent us. Your views on the 25th Amendment, Section 3 of the 14th Amendment, and the impeachment are appreciated as we continue. I am responding to your communications in chronological order and will do so overnight.

Thank you for your patriotism.

In prayer,

Call on Vice President Michael R. Pence to summon and mobilize key leaders of Cabinet executive departments to activate Section 4 of the 25th Amendment to declare President Donald J. Trump unable to perform the duties of his office and d ” immediately exercise his powers as interim president.

Whereas Wednesday January 6, 2021, day fixed by

Constitution for the counting of electoral votes, Congress experienced a massive violent invasion of the United States Capitol and its compound by a dangerous insurgent mob who smashed windows and used violent physical force and weapons to subdue and thwart the United States Capitol Police and facilitated the illegal entry into the Capitol of hundreds, if not thousands of unauthorized persons (all of whom entered the Capitol complex without passing through metal detectors and other security devices. Security controle);

As the insurgent mob threatened the safety and lives of the Vice President, Speaker of the House and President pro tempore of the Senate, the first three individuals in the line of succession to the presidency, as rioters were recorded in singing ” Hang on Mike Pence ‘and’ Where’s Nancy ‘when President Donald J. Trump tweeted to supporters that’ Mike Pence didn’t have the courage to do what should have been done to protect our country ” after the Capitol had been invaded and the vice president was in hiding;

As the insurgent mob attacked law enforcement officers, unleashed chaos and terror among members and staff and their families, occupied the Senate Chamber and President Nancy Pelosi’s office as well as other executive offices, vandalized and looted government property, and managed to interfere with the counting of electoral votes during the joint session of Congress;

As the insurgent mob’s violent attacks on law enforcement and the invasion of the Capitol complex caused an unprecedented disruption of the Electoral College’s counting process for a period of 4 hours both in the House and in the Senate, a dangerous and destabilizing attack on the peaceful transfer of power that these insurrectional riots were explicitly intended to provoke;

While 5 Americans have died from injuries or trauma suffered in this violent attack on Congress and the Capitol, including Capitol policeman Brian D. Dicknick and Ashli Babbitt, Rosanne Boyland, Kevin Greeson and Benjamin Phillips, and more than 50 police officers
officers were seriously injured, including 15 officers who had to be hospitalized, by violent assaults, and there could easily have been dozens or hundreds more injured and killed, a sentiment captured by Senator Lindsey Graham, who observed that “ the crowd could have blown up the building. They could have killed us all ”;

While these insurgent protests were widely heralded and widely encouraged by President Donald J. Trump, who has repeatedly urged his millions of followers on Twitter and other social media to come to Washington on January 6 to “ stop the ‘robbery’ of the 2020 presidential election and promised its militant supporters that the protest on the day of the electoral college count would be ‘savage’;

As President-elect Joseph R. Biden won the 2020 presidential election with more than 81 million votes and defeated President Trump 306-232 in the Electoral College, a margin declared to be a “ landslide ” by President Trump when he won by the same electoral college
figures in 2016, but President Trump never accepted these election results as legitimate and waged a long campaign of propaganda and coercive pressure in federal and state courts, in state legislatures, with secretaries of State and Congress to cancel and
cancel these results and replace them with fraudulent and fabricated numbers;

Whereas President Trump has made at least 3 attempts to interfere with Georgia’s legal vote counting and certification process and to force local officials to fraudulently declare him the winner of state election votes, including appeals to the Georgia Governor Brian Kemp and a state election investigator, and an hour-long conversation with Secretary of State Brad Raffensperger to harass him to “find 11,780 votes” and warn him of a “big risk ”to Raffensperger if he did not intervene favorably to guarantee the re-election of President Trump;

Whereas President Trump appeared with members of his staff and family at a launch rally to encourage and charge rioters and insurgents to “ march on Capitol Hill ” and “ fight ” Wednesday January 6, 2021;

As violent insurgents occupied parts of Capitol Hill, President Trump ignored or rejected repeated real-time pleas from President Nancy Pelosi and Senate Minority Leader Chuck Schumer to call on his supporters to leave Capitol Hill, and also ignored a tweet from Alyssa Farah, her former communications director, saying, “Condemn this now, @ realDonaldTrump – you’re the only one listening. For our country! ”;

While photographs, cell phone videos, social media posts and reports from the field show that many violent insurgents who invaded the Capitol were armed, wearing police-grade flexible handcuffs to detain and handcuff people , used a sledgehammer, pepper spray and bear spray against United States Capitol police officers, erected a gallows on the Capitol grounds to hang “ traitors ”, vehemently chanted “ Hang Mike Pence! while circling and walking around the Capitol, pointed out that the assault on the Capitol was “ a revolution, ” waved the Confederate battle flag inside the Capitol, and was found to be in possession of Napalm B, as still unidentified culprits planted several homemade bombs in buildings near the Capitol complex, another deadly dangerous criminal action that successfully hijacked law enforcement on Capitol Hill; and

As Donald Trump has repeatedly, continuously and dramatically demonstrated his utter inability to discharge the most basic and fundamental powers and duties of his office, most recently including the duty to respect the legitimate results of the presidential election, the duty to respect the peaceful transfer of democratic power under the Constitution, the duty to participate in transitional activities defined by law, the duty to protect and uphold the Constitution of the United States, including the counting of electoral college votes by Congress, the duty to protect the people of the United States and their elected representatives from domestic insurgency, mob rule and seditious violence, and generally the duty to ensure that the laws are faithfully executed:

1 Resolved, which the House of Representatives calls
2 on Vice President Michael R. Pence—
3 (1) to immediately use his powers under section
4 4 of the 25th amendment to convene and mobilize

7 nation: that the president is unable to succeed
8 discharge the duties and powers of his office; and
9 (2) to be sent to the president pro tempore of
10 the Senate and the President of the Chamber of Rep.
1 people felt notice that it will immediately be like-
