Dear Acting Secretary Miller,
I am writing to follow up on my telephone conversation with you earlier today, in which I expressed my deep concern about the irregularities related to the selection of the National Security Agency (NSA) Legal Advisor. I ask you to immediately cease your plans to improperly install Michael Ellis as the new NSA legal counsel. Further, along with a copy of this letter to the Acting Inspector General, I also request an investigation into the circumstances of the NSA General Counsel selection process. I am very concerned about your statement that this process was free from political interference.
Public reports indicate that Mr Ellis, a relatively recent law graduate with a limited resume, was selected due to White House interference and was chosen from much more qualified applicants. Additionally, Mr Ellis has reportedly been involved in highly questionable activities that are disqualifying – including the infamous 2017 ‘midnight run’ to launder intelligence information via Representative Devin Nunes and with efforts to protect information on President Trump’s appeal in July 2019 with the President of Ukraine.
The NSA General Counsel, which involves overseeing numerous lawyers in the intelligence community and interacting with intelligence agencies, is a very sensitive career position for which candidates are selected, on the basis of merit and without political influence. If Mr. Ellis has gone through the traditional public service hiring process, I ask for a detailed account of that process, to understand how a person with his credentials was selected over other qualified candidates. The circumstances and timing – immediately following President Trump’s defeat in the election – of Mr. Ellis’ selection, and this eleventh-hour effort to push that placement over the last three days of this administration are highly suspect. In addition, efforts to install or “dig” him into a highly sensitive intelligence post 72 hours before a new administration begins demonstrates a worrying disregard for our national security. Therefore, this placement should not advance.
