Senate Minority Leader Chuck Schumer called on the Senate to confirm Joe Biden’s Cabinet nominees BEFORE his potential inauguration on January 20, 2021.
“Everyone knows that the Senate plays a central role in confirming the cabinet of a new president,” Schumer told the Senate on Monday. “In the midst of this once-in-a-century crisis, it is imperative that the next administration can count on the Senate to confirm its cabinet without delay.
“Hearings on President-elect Biden’s candidates are expected to begin in January immediately after the second round of elections in Georgia,” Schumer said, referring to the two January 5 elections that will decide which party controls the Senate.
Ignoring the ensuing legal battles over voter fraud in battlefield states like Pennsylvania and Georgia, Schumer said the Senate should “go with precedent” and have Biden’s cabinet members confirmed by January 20. .
“The Senate is expected to follow precedent and hold hearings on President-elect Biden’s candidates in January immediately after the Georgia election, ahead of the inauguration,” Schumer said.
According to the appointment clause of the Constitution:
… And [the President] appoints, and on the advice and consent of the Senate, appoints ambassadors, other ministers and public consuls, judges of the Supreme Court, and all other officers of the United States, whose appointments are not otherwise provided for by the present, and which shall be established by law: but Congress may, by law, entrust the appointment of inferior officers, as it sees fit, to the president alone, to the courts or to the heads of departments.
Although Congress held hearings for Cabinet candidates ahead of the inauguration day of a new president, confirming a cabinet member before Biden being sworn in on January 20, 2021 would be unconstitutional because Biden would not be sworn in as president until noon that day.
President Trump had faced unprecedented confirmation delays during his transition in 2017 and only got half of his cabinet confirmed in mid-February.
