Constitutional attorney Alan Dershowitz believes President Trump will emerge victorious in the Pennsylvania trial against the voting deadline extensions.
Dershowitz explained to Breitbart news Friday that the reason is simple: The Supreme Court of Pennsylvania implemented an election law that had not been approved by its legislature, an unconstitutional action.
“I think Trump will win the Pennsylvania lawsuit … namely, the lawsuit that challenges the ballots that were cast before the end of election day, but were not received until after election day,” Dershowitz said.
“The [Pennsylvania] lawmakers had basically said no to that, and the state Supreme Court said yes because of the pandemic.
Dershowitz added that the court may have made the “right decision” in a “theoretical sense,” but that does not excuse its unconstitutionality.
“It may have been the right decision in a certain theoretical sense, but the Constitution does not allow anyone in the state, but the legislature, to make decisions about elections.
Dershowitz noted that the Supreme Court can weigh in depending on the strength of a case presented by Republicans.
“The Supreme Court will only take this case if it would make a difference, only if the plaintiffs – the Republicans – can show that the number of disputed ballots that have been sequestered by Judge Alito’s ruling exceeds the difference between the winning margin and the loss of margin. “
“Pennsylvania’s constitutional argument is a comprehensive argument that clearly belongs to the federal courts,” he added.
Last week, Justice Samuel Alito hinted that the Pennsylvania Supreme Court could take the case when he ordered state election commissions to separate ballots that arrived after 8 p.m. on election day.
